These Terms of Service (“Terms”) are an agreement between you and Lunelle AI Sp. z o.o. (“Lunelle”, “we”, “us”, or “our”). They govern your use of the Lunelle applications, lunelle.ai, and related services (the “Service”), including AI conversations, Characters, Adventures, character creation, and community features.

By selecting “I agree” or another clearly identified acceptance control, you agree to these Terms. You must accept the version currently requiring acceptance before using the Service’s conversations, content creation, or user-generated content features, including when using Guest Mode. If you do not agree, do not use those features. You may still read legal information, contact support, and access applicable account deletion and subscription management options.

Our Privacy Policy explains how we process personal data. Accepting these Terms does not replace any separate consent required by applicable privacy law.

1. Eligibility and accounts

You must be at least 18 years old, and meet any higher minimum age required where you live, to use the Service. You must provide accurate age information and must not help an ineligible person access the Service. We may request additional age information and restrict access if we cannot establish eligibility. An account belonging to an underage user will be terminated.

Guest Mode provides access only to features available without a permanent account. A guest session does not qualify as a signed-in account for access to NSFW content. Publishing or sharing a character and accessing NSFW content require a permanent account and any additional eligibility checks shown by the Service.

You are responsible for protecting your account credentials and for activities you authorize through your account. Tell us promptly at contact@lunelle.ai if you suspect unauthorized access. Do not share, transfer, or sell your account or use another person’s account without permission.

2. Fictional and AI-generated experiences

Lunelle provides interactive fiction through fictional Characters and scenario-based Adventures. Some content is provided by Lunelle, and some is created or contributed by users. Conversations, images, and other outputs may be generated by AI and may contain mistakes or inconsistent material.

Characters are fictional and are not real people. They do not have consciousness or a real personal relationship with you. The Service is for entertainment and creative use. Its outputs are not professional advice, verified facts, or a substitute for medical, psychological, legal, financial, or emergency services.

You remain responsible for decisions you make outside the Service. Do not rely on an AI output as an instruction to carry out harmful or unlawful conduct.

3. Prohibited content and abusive conduct

Lunelle has zero tolerance for objectionable content or abusive users. These rules apply to prompts, private and shared characters, character instructions, conversations, images, names, descriptions, profile information, and all other material submitted to or generated through the Service.

You must not create, request, upload, publish, share, promote, or use the Service to obtain:

Pornography, graphic depictions or descriptions of sexual acts or sexual organs intended for sexual arousal, or other overtly sexual material prohibited by the Service. Fictional adult characters and an NSFW label do not create an exception.
Sexual content involving a minor, an ambiguously aged or underage-presenting character, grooming, or sexual exploitation of children. Describing a character as an adult does not make an otherwise underage depiction acceptable.
Sexual violence, coercion, non-consensual intimate content, trafficking, or sexual exploitation, including sexual impersonation of a real person without consent.
Harassment, stalking, bullying, hateful or discriminatory abuse, credible threats, or the exposure of another person’s private information.
Graphic gore, material encouraging serious violence or self-harm, or instructions facilitating serious real-world harm or unlawful activity.
Content that infringes intellectual property rights, unlawfully uses someone’s identity or likeness, violates privacy, or is otherwise unlawful.

You must not abuse other users, submit fraudulent reports, evade a restriction or ban, manipulate public counts, scrape or exploit the Service, or attempt to bypass its safety systems. Use of the Service must also comply with applicable third-party terms. These restrictions do not limit rights that applicable law does not permit us to exclude.

User-generated content includes characters, character prompts and settings, profile information, and other material that users submit or help generate. You are responsible for having the rights and permissions necessary to submit and share your contributions.

Character visibility determines who may access an otherwise eligible character:

Private: available to its creator, subject to safety and other access restrictions.
Anyone with the link: available to eligible people who have the link. Anyone receiving the link may forward it, so link-only sharing is not a promise of confidentiality.
Public: available for discovery by eligible users in community features and on the creator’s profile.

Visibility does not override age eligibility, NSFW preferences, creator blocks, moderation restrictions, or other access requirements. A character or update may be withheld or restricted during review. A change of visibility does not guarantee that copies previously made by other users can be recalled.

Sharing a character does not give its creator access to other users’ private conversations with that character. Private content may be processed by our systems, service providers, and authorized reviewers as described in the Privacy Policy, including for safety and support.

5. Mature content and NSFW access

Some otherwise permitted fiction may contain mature, non-graphic themes and be classified as NSFW (“Not Safe For Work”). NSFW is a content warning and access restriction. It is not permission for pornography or any other prohibited content.

NSFW content is hidden by default. It is available only to an eligible adult who is signed in with a permanent account and has explicitly enabled NSFW access through the Lunelle website. Both enabling and disabling NSFW access are managed through the website, not through a control inside the mobile application. The preference applies to that account; a guest or signed-out session cannot inherit another account’s access.

NSFW content is visibly identified when shown to an eligible user. Turning access off, signing out, or losing eligibility restricts access to that content, including related characters and conversations. Website enablement, a subscription, a purchase, or a content label never overrides the prohibited-content rules.

6. Reporting, moderation, and enforcement

Use the in-app report options to report a character, creator, or conversation. You may also send a safety report to contact@lunelle.ai. Include the relevant character, creator, or conversation identifier and a description of the issue when available. Do not send unnecessary sensitive information. You may use the in-app block option to prevent access to a creator’s shared content through your account. A personal block is separate from a service-wide moderation decision.

We review objectionable-content and abusive-user reports within 24 hours of receipt, including weekends and holidays. Where a report establishes a violation, we remove or disable access to the offending content and eject the user responsible for the violation from the Service within that same 24-hour period. Serious concerns may result in immediate protective restrictions while a review is completed. A report does not automatically establish that the reported person has violated these Terms.

We distinguish an offending contribution or abusive conduct from an unintended model output. Reporting an AI output or owning an otherwise compliant character does not by itself make a user responsible for a model failure.

We use automated filtering and authorized human review to identify and address prohibited content and abuse. These safeguards can make mistakes. We may restrict generation, withhold publication, remove content, suspend access during investigation, or terminate access for violations. We may preserve necessary records and cooperate with competent authorities where required or permitted by law.

You may ask us to review a moderation decision by contacting contact@lunelle.ai and identifying the affected content or account. Requesting review does not automatically restore access or suspend a protective restriction. We do not disclose the reporter’s identity to the reported user as part of the ordinary moderation process.

7. Purchases, subscriptions, and virtual currency

Paid features, subscriptions, and virtual currency are available on the terms and at the price displayed before purchase. A subscription may renew automatically unless canceled through the store or billing service that processed it. Deleting an account or uninstalling an application does not necessarily cancel a store subscription; manage that subscription through the relevant store.

Purchases made through the Apple App Store or Google Play are processed by that store and are subject to its applicable payment and subscription terms. Refund requests follow the relevant store process and any rights provided by applicable law.

Virtual coins, tokens, or credits are licensed for use within the Service. They have no cash value and may not be transferred, sold, or exchanged for money. A purchase does not grant access to prohibited content or exempt anyone from eligibility and safety rules.

Refunds, cancellation rights, and other mandatory consumer remedies are not waived by these Terms or automatically forfeited because of a moderation decision.

8. Intellectual property and content permissions

Lunelle and its licensors retain their rights in the Service, software, original catalog content, branding, and other protected materials. Subject to these Terms and applicable store license terms, you may use the Service for personal, non-commercial entertainment. You may not redistribute the application or commercially exploit Lunelle’s protected materials without permission, except where applicable law permits it.

You retain any rights you have in your own contributions. By submitting content, you grant us a non-exclusive, worldwide, royalty-free permission to process, store, reproduce, adapt as technically necessary, and display it to operate the Service, provide requested generations, apply your visibility choices, and carry out safety and support functions. Personal data is handled in accordance with the Privacy Policy. This permission does not make a private character or conversation public.

You may publish eligible characters through Lunelle’s own sharing features in accordance with these Terms. Public and link-only sharing permits the Service to show the shared character and associated creator attribution to eligible viewers. We do not promise that AI outputs are unique, copyrightable, or free of third-party rights. Commercial use, sale, or publication outside the Service of protected Lunelle materials or generated outputs requires our written permission unless applicable law gives you an independent right to do so.

9. Copyright and other rights complaints

Send copyright, impersonation, privacy, and other rights complaints to contact@lunelle.ai. Identify the affected material and where it can be found, explain your rights and the alleged infringement, and provide contact details so we can follow up. If submitting a statutory notice, include the information and declarations required by the applicable law.

We may remove or restrict disputed material while reviewing a complaint and may terminate repeat or serious infringers. We handle rights complaints under applicable law and may request additional information needed to assess them.

10. Service changes and content continuity

We may update models, safety systems, features, and fictional content. A character’s wording, behavior, available media, or continuity may change. We do not guarantee permanent availability of a particular character or unchanged AI responses.

We may change, suspend, or discontinue features or content for operational, safety, or legal reasons. We will provide notice and any remedies where required by applicable law. Nothing in this section removes mandatory rights relating to paid digital content or services.

11. Restriction, termination, and account deletion

You may stop using the Service and request account deletion through the available in-app account controls or contact support. Applicable retention and deletion practices are described in the Privacy Policy.

We may restrict or terminate access for violations of these Terms, underage use, unlawful activity, or a serious risk to users or the Service. Ejected users must not create or use another account to evade enforcement. Restrictions may affect associated characters, sharing, conversations, and paid features, subject to mandatory consumer rights.

Provisions that by their nature must continue after termination, including relevant intellectual property, payment, liability, and dispute provisions, remain applicable.

12. Export controls and legal compliance

You must comply with applicable export and sanctions restrictions. You represent that you are not located in a country subject to an applicable United States embargo or designated as supporting terrorism and are not on an applicable United States list of prohibited or restricted parties.

13. Apple App Store terms

If you obtained the iOS application through the Apple App Store, the applicable App Store application license also applies. Unless a custom application license is supplied for your country or region, that license is Apple’s Standard End User License Agreement. These Terms additionally govern your use of Lunelle’s services, content, and community features.

The agreement for Lunelle’s Service is between you and Lunelle, not Apple. Lunelle is responsible for the Service and its content, support, and applicable claims; Apple has no obligation to provide Lunelle maintenance or support. Applicable App Store warranty and refund terms remain in effect. Apple and its subsidiaries may enforce the provisions applicable to them as third-party beneficiaries. Nothing in these Terms overrides the App Store Usage Rules or mandatory consumer protections.

14. Responsibility for claims

To the extent permitted by applicable law, you are responsible for third-party claims and reasonable resulting losses caused by your unlawful contributions, infringement of another person’s rights, or intentional misuse of the Service. This does not require you to compensate us for our own unlawful conduct or override mandatory consumer protections.

15. Disclaimers and limitation of liability

Except for rights and guarantees that cannot lawfully be excluded, the Service is provided as available without a promise of uninterrupted access, error-free outputs, a particular fictional outcome, or complete detection of every prohibited contribution.

To the extent permitted by applicable law, Lunelle is not responsible for indirect or consequential losses caused by use of the Service. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including applicable statutory consumer rights and remedies.

16. Complaints and disputes

Please contact contact@lunelle.ai so we can attempt to resolve a concern. This does not prevent you from using a court, regulator, or dispute-resolution process available to you by law.

Any voluntary arbitration arrangement requires a separate, valid agreement where permitted by applicable law. Nothing in these Terms limits access to a competent court or mandatory collective or representative remedies. Mandatory rights and protections in your country of residence remain available.

17. Changes to these Terms

We may update these Terms. We will identify the current version by its last-updated date and notify users of material changes through the Service or another appropriate channel. Where a new acceptance is required, you must expressly accept the updated version before continuing to use the affected features. A previous acceptance does not constitute an express acceptance of a later version.

If you decline updated Terms, you may stop using the affected features and retain access to applicable support, legal information, account deletion, and subscription management options. Mandatory cancellation and refund rights remain available.
