Welcome to Lunelle.ai. These Terms and Conditions (“Terms”) constitute a legally binding agreement between you and Lunelle.ai (“we,” “our,” or “us”) governing your use of our iOS application and related services (collectively, the “Service”). By downloading, accessing, or using the Service, you agree to be bound by these Terms.

1. Eligibility and Age Requirements

You must be at least eighteen (18) years of age to access and use the Service. By using the Service, you represent and warrant that you meet this age requirement. We reserve the right to request proof of age at any stage to verify compliance. If we discover you are under 18, your account will be immediately terminated.

2. Nature of the Service

The Service provides access to a curated roster of pre-defined, fictional AI personas—spanning various archetypes from executives and physicians to artisans and everyday companions—designed strictly for entertainment and virtual companionship. You acknowledge and agree that:

• All interactions are generated by artificial intelligence models.
• The characters are entirely fictional, do not possess real-world consciousness, and their responses should not be taken as factual, medical, psychological, legal, or professional advice.
• Interactions may involve descriptive text roleplay, utilizing stylized formatting (such as the use of asterisks to denote fictional *actions and thoughts*) alongside plain text dialogue.

3. Acceptable Use and Roleplay Boundaries

While the Service permits mature, romantic, and sensual roleplay within the boundaries of our safety systems, users must strictly adhere to our content guidelines. You may not use the Service to generate, promote, or engage in:

• Explicit pornography or graphically violent sexual acts.
• Non-consensual sexual content, including the depiction of minors or non-consenting real-world individuals.
• Hate speech, harassment, stalking, or direct threats of violence against real people.
• Illegal activities, fraud, or the promotion of self-harm.

4. System Integrity and Moderation

You are strictly prohibited from attempting to bypass, manipulate, or “jailbreak” the Service’s safety filters to generate prohibited content. You may not reverse-engineer the AI models, scrape data, or exploit system vulnerabilities.

We employ automated systems to maintain a safe environment. In the event of a violation, we reserve the right, at our sole discretion, to take appropriate action. This may include issuing warnings, temporarily suspending access, or permanently terminating your account without a refund. We are not obligated to actively monitor all interactions but reserve the right to review flagged content to ensure compliance.

5. Purchases, Tokens, and Subscriptions

The Service may offer virtual tokens, credits, or premium subscriptions. All purchases made through the Apple App Store are processed by Apple and are subject to Apple’s payment terms and conditions.

• Virtual Currency: Tokens or credits purchased or earned are licensed to you solely for use within the Service. They possess no real-world monetary value, cannot be exchanged for cash, and are non-transferable.
• Refunds: All purchases are final and non-refundable, except where required by applicable law or subject to Apple’s mandatory refund policies.

6. Intellectual Property

Our Ownership: We retain all rights, title, and interest in and to the Service. This includes the proprietary underlying AI models, the user interface, and all pre-defined fictional personas, their names, backstories, and associated visual assets. You are granted a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial entertainment.

User Prompts and Outputs: By submitting text prompts to the Service, you grant us a worldwide, non-exclusive, royalty-free license to use, store, and process those prompts to generate responses, provide the Service, and improve our AI models. You may not commercially exploit, publish, or sell the generated outputs without our express written consent.

7. Copyright Policy (DMCA)

We respect the intellectual property rights of others. If you believe that any content within the Service infringes upon your copyright, please provide our designated Copyright Agent with a written notice containing the information required by the Digital Millennium Copyright Act (DMCA) at [Insert DMCA Email Address].

8. Modification of Service and Character Continuity

We are constantly evolving our Service to improve user experience. We reserve the right to modify, suspend, or discontinue any part of the Service at any time, without prior notice or liability. This specifically includes the right to update, alter the underlying prompts or behavioral traits of, or completely remove any of our pre-defined AI personas from our active roster. You acknowledge that interactions with AI companions may change over time and that we are not liable for any perceived loss of conversational continuity or alteration in a character’s established behavior.

9. Account Security and Credentials

You are solely responsible for maintaining the confidentiality of your account login information and are fully liable for all activities that occur under your account. You agree to immediately notify us of any unauthorized use or suspected breach of security. We cannot and will not be liable for any loss or damage arising from your failure to comply with this security obligation.

10. Export Controls and Sanctions

As required by standard app distribution platforms, by using the Service, you represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties. You agree to comply strictly with all applicable export control laws and regulations.

11. Apple App Store Additional Terms

If you downloaded the app from the Apple App Store, the following terms apply:

• Acknowledgment: You and Lunelle.ai acknowledge that these Terms are concluded between you and Lunelle.ai only, and not with Apple. Lunelle.ai, not Apple, is solely responsible for the Service and the content thereof.
• Scope of License: The license granted to you for the Service is a non-transferable license to use the Service on any Apple-branded products that you own or control as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions.
• Maintenance and Support: Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the Service.
• Warranty: In the event of any failure of the Service to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the app (if applicable). Apple will have no other warranty obligation whatsoever with respect to the Service.
• Product Claims: You acknowledge that Lunelle.ai, not Apple, is responsible for addressing any claims relating to the Service.
• Third-Party Beneficiary: You and Lunelle.ai acknowledge and agree that Apple, and Apple’s subsidiaries, are third-party beneficiaries of these Terms, and that Apple will have the right to enforce these Terms against you as a third-party beneficiary.

12. Indemnification

You agree to indemnify, defend, and hold harmless Lunelle.ai, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your generation of prohibited content.

13. Disclaimer of Warranties and Limitation of Liability

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, LUNELLE.AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; OR (C) ANY RELIANCE ON THE FICTIONAL CONTENT GENERATED BY THE AI.

14. Dispute Resolution, Arbitration, and Class Action Waiver

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

Any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof, including the determination of the scope or applicability of this agreement to arbitrate, shall be determined by binding individual arbitration rather than in court.

Class Action Waiver: You and Lunelle.ai agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. If for any reason a claim proceeds in court rather than in arbitration, we each waive any right to a jury trial.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the new Terms within the app or via email. Your continued use of the Service following any changes constitutes your acceptance of the new Terms.
